Notice is given that the Zoning Hearing Board of Upper Makefield Township will hold a public meeting at the Upper Makefield Township Building, 1076 Eagle Road, Newtown, Pennsylvania, on Tuesday, June 24th, 2008 at 7:30 P.M. to hear the Application of Gary & Rosina Gilbert, 100 Street Road, New Hope, PA 18938 regarding Tax Parcel No. 47-1-51-4, which is located at the address of the Applicants set forth above in the C-M, Conservation Management District of Upper Makefield Township. The Applicants have filed an appeal from the denial of an application for an erosion and sedimentation control and grading permit. Additionally, the Applicants request variances and/or special exceptions from, or pursuant to, §902 and §903 of the Ordinance in order to permit the installation of a driveway and/or drainage facilities from the subject property, as well as variances and/or special exceptions from the requirements of §905 of the Ordinance, and from Exhibit "B" thereto, with regard to the construction of the driveway and/or drainage facilities proposed on the property within a flood plain. Finally, the Applicants have filed a validity challenge to §900 through and including 905 of the Ordinance. Notice is given that the Zoning Hearing Board of Upper Makefield Township will hold a public meeting at the Upper Makefield Township Building, 1076 Eagle Road, Newtown, Pennsylvania, on Tuesday, June 24th, 2008 at 7:30 P.M. to hear the Application of Gary & Rosina Gilbert, 100 Street Road, New Hope, PA 18938 regarding Tax Parcel No. 47-1-51-4, which is located at the address of the Applicants set forth above in the C-M, Conservation Management District of Upper Makefield Township. The Applicants have filed an appeal from an enforcement notice issued by the Assistant Code Enforcement Officer of Upper Makefield Township, alleging a violation of §903.6.c of the Newtown Area Joint Municipal Zoning Ordinance, which prohibits the removal of trees with a girth greater than 10 inches from the property. Notice is given that the Zoning Hearing Board of Upper Makefield Township will hold a public meeting at the Upper Makefield Township Building, 1076 Eagle Road, Newtown, Pennsylvania, on Monday, June 2, 2008 at 7:30 P.M. to hear the Application of Fred Carlo, 598 Rosalie Street, Philadelphia, PA 19120 regarding Tax Parcel Nos. 47-9-64 and 47-9-78, which are vacant lots located on River Road, Washington Crossing, PA 18977. The Applicant proposes the construction of a single family detached dwelling on the subject properties, which are undersized and non-conforming to the minimum lot area requirements of the Ordinance and requests relief from the Newtown Area Joint Municipal Zoning Ordinance, in order to do so, as follows: 1) A variance from §401.B to permit this use on a lot that will result in a gross density of greater than .33 dwelling units per acre; 2) A variance from §401.B to allow this use without providing the required open space; 3) A variance from §401.B to allow an impervious surface ratio of 24%, instead of the maximum allowable 15%; 4) A variance from §401.B to allow this use on a lot with a minimum gross site area of less than 3 acres; 5) A variance from §401.B and .C to allow this use on a lot with a minimum lot area of less than one acre; 6) A variance from §401.C to allow a minimum lot width at the building setback line of 150.07 ft., instead of the required 200 ft.; 7) A variance from §401.C. to allow a front yard setback distance of 25 ft. from the ultimate right-of-way and 58.5 ft. from the legal right-of-way, instead of the required 100 ft. minimum front yard setback distance; 8) A variance from §401.C to allow side yard setback distances of 44 ft. and 36 ft., instead of the required 50 ft.; 9) A variance from §401.C to allow a distance of 79.3 ft. between the proposed dwelling and a neighboring structure, instead of the required 100 ft.; 10) A variance from §401.footnote 5a to allow this use on a lot with less than 20,000 sq. ft. of unrestricted area; 11) A variance from §902.B.2. to allow construction of the single family detached dwelling within a flood plain and on flood plain soils, 12) A variance from §902.B.2.b and §903.B.5.a to allow disturbance of 85% of the woodlands on the lot, instead of the maximum disturbance permitted of 15%; 13) A special exception pursuant to, and/or a variance from §903.B.1 to allow construction of the dwelling and filling in the flood plain; 14) A special exception, pursuant to §903.B.13.e.1, to allow construction of a structure in Zone 2 of the riparian buffer overlay zone; 15) A variance from §903.B.13.e.4 to allow construction of a single family detached dwelling within Zone 2 of the riparian buffer overlay zone; 16) A variance from §903.B.13.g in order to eliminate the requirement for restoration of the re-vegetation of the riparian buffer; 17) A variance from §903.B.9 to allow storm water runoff to exceed the pre-development rate; 18) Variances from §905.IV.a to allow the proposed construction and fill within a flood plain district; 19) A variance from §905.IV.A.3 to allow impervious parking areas and driveway; 20) A variance from §905.IV.D.6 to permit construction of a private sewage system within the flood plain and from regulations in order to allow a private well within the flood plain; and 21) A validity variance, pursuant to §1507.A. Notice is given that the Zoning Hearing Board of Upper Makefield Township will hold a public meeting at the Township Building, 1076 Eagle Road, Newtown, Pennsylvania, on Monday, June30, 2008 at 7:30 P.M. to hear the Application of Joel Petty & Karin Traina, 1159 River Road, Washington Crossing, PA regarding Tax Parcel No. 47-20-6-000, which is located at 1896 Wrightstown Road, Washington Crossing, PA in the CM, Conservation Management District of Upper Makefield Township. The Applicants propose to expand an existing one story structure on the property and to convert its use to a professional office and, in order to do so, request the following relief from the Newtown Area Joint Municipal Zoning Ordinance: 1) A variance from §401.A to allow that use, which is not permitted in the CM Conservation Management District; 2) A variance from §401.B to allow an impervious surface ratio of 23%, instead of the maximum 15%, and existing 15.5%; 3) Variances from §1001.F.4 and .6.a to permit required parking to be located within the minimum front yard setback distance, and within the area between the legal and ultimate right-of-way of Wrightstown Road; 4) A variance from §1007.F.6.b to eliminate the requirement for buffering along the property's road frontage; and 5) A variance from §803.D.1.5 so as to permit 5 parking spaces for the proposed professional office use, instead of the 8 parking spaces required. Notice is given that the Zoning Hearing Board of Upper Makefield Township will hold a public meeting at the Township Building, 1076 Eagle Road, Newtown, Pennsylvania, on Monday, June 30, at 7:30 P.M. to hear the Application of Marion M. Wesley, 645 Pineville Road, Newtown, PA regarding Tax Parcel No. 47-4-65-000, which is located at the address of the Applicant. The property is located in the CM, Conservation Management and JM, Jericho Mountain Districts of Upper Makefield Township. The Applicant desires to construct a new service barn on the property and requests a variance from §803.A.2.b of the Newtown Area Joint Municipal Zoning Ordinance in order to permit the barn to be located 17.5 ft. from its closest property line, instead of the required 75 ft. Additionally, the Applicant requests a special exception, pursuant to §400.D.1 to allow approximately 50% of the barn to be located on slopes in excess of 15%.
